Acceptance of Terms

By accessing or using the website at sanclementeasphaltpaving.com (the "Site"), or by requesting, scheduling, or receiving services from San Clemente Asphalt Paving ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Site or our services. We reserve the right to update these terms at any time, and your continued use of the Site or services after any change constitutes your acceptance of the revised terms.

Description of Services

San Clemente Asphalt Paving is an asphalt paving contractor based in San Clemente, CA. We provide residential and commercial asphalt paving, sealcoating, repair, striping, and related services in San Clemente and surrounding communities. Services are provided only at locations we agree to serve and only for work described in a written or verbal estimate or agreement.

Estimates and Pricing

All estimates we provide are based on information available at the time of the estimate, including a visual inspection of the work site where applicable. Estimates are not guaranteed final prices. Final pricing may change if:

• The scope of work changes at your request or due to conditions discovered during the job
• Site conditions differ materially from what was visible during the initial estimate
• Material costs change between the estimate and the start of work
• Additional work is required to complete the job properly and safely

We will notify you of any material change in price before proceeding. Written estimates are valid for 30 days from the date issued unless stated otherwise.

Scheduling and Cancellations

Work is scheduled based on crew availability, weather conditions, and materials lead time. We reserve the right to reschedule work due to weather conditions that would compromise the quality or safety of the job, including rain, extreme heat, or high humidity.

If you need to cancel or reschedule a scheduled job, please notify us as soon as possible. Cancellations made with less than 48 hours notice may result in a cancellation fee to cover mobilization costs already incurred.

We are not liable for delays caused by weather, supply shortages, permit delays, or other circumstances outside our control.

Payment Terms

Payment terms will be specified in your written estimate or work agreement. In general:

• A deposit may be required before work begins on larger projects
• Final payment is due upon completion of the work unless other terms are agreed in writing
• Accepted payment methods will be communicated to you at the time of scheduling

Invoices not paid within the agreed timeframe may be subject to a late fee. If collection efforts are required, you agree to reimburse us for reasonable costs of collection, including attorney fees, to the extent permitted by law.

Your Responsibilities

To allow us to complete work properly, you agree to:

• Provide clear access to the work area on the scheduled date
• Remove vehicles, personal property, and obstacles from the work area before our crew arrives
• Inform us of any underground utilities, pipes, or other hazards in the work area
• Obtain any permits required for the work under applicable local laws, unless we agree in writing to handle permitting
• Keep the work area clear of foot traffic and vehicles during curing periods as directed by our crew

Warranty Disclaimer

We stand behind our work and will address any defects resulting from our workmanship within a reasonable period after completion, as specified in your written agreement. However, we cannot warrant against:

• Normal wear and aging of asphalt surfaces
• Damage caused by acts of nature, heavy equipment not disclosed before work, tree roots, or ground movement
• Deterioration resulting from lack of routine maintenance after completion
• Existing subsurface conditions not visible or disclosed before work began

Our Site and any content on it are provided "as is" without warranty of any kind. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

Limitation of Liability

To the fullest extent permitted by law, San Clemente Asphalt Paving shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from services we provide shall not exceed the amount you paid us for the specific service giving rise to the claim.

Intellectual Property

All content on this Site - including text, images, logos, and design - is owned by or licensed to San Clemente Asphalt Paving and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or use any content from this Site without our written permission.

Dispute Resolution

We prefer to resolve disputes informally. If you have a concern about our work or billing, contact us directly at hi@sanclementeasphaltpaving.com or (714) 386-7860 and we will work to address it. If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing other legal remedies. Nothing in this section limits your rights under applicable consumer protection law.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action arising from these terms or our services shall be brought in a court of competent jurisdiction in California.

Modifications to These Terms
